What are your views on same sex marriage, should it be legal or illegal? also what do you think about Proposition 8?

I already had a topic for this up called Prop 8. It didn't get moved into Debate Sub Forum though.
Basically, Prop 8 should never have existed in the first place. You don't leave the rights of the minority which are basically protected by the constitution to majority rule.
Same sex marriage is perfectly fine. To each his own. It should never be illegal. There is no reason that two people of the same sex shouldn't be allowed to reap the benefits of marriage.
And I mean legal marriage, not religious marriage. There is a difference.

I personally am appalled with the results of Proposition 8. It's as if the gay marriage laws passed in the summer never existed to begin with.

Proposition 8 takes away no rights, it is not a civil rights issue. Marriage is defined as a man and a women. Same sex couples can still get a civil union which is no different than a marriage except in name only. I have no problem if same sex couples have civil unions, but marriage is between a man and a woman, period.
Legal marriage = civil union.
And to retort mrfabulous' answer, its as if the proposition in 2000 never existed to begin with. Before you claim that Prop 8 totally goes against a previous ruling, the courts went against the previous proposition made in 2000 which defined marriage as between a man and a woman.

For religious marriage in a church, i think its the church's decision to marry gay couples, but Legal gay marriage should be allowed.

There's a decent argument that marriage is a fundamental right (you can find it in the penumbra of rights consisting of privacy, Roe v. Wade, Griswold, Lawrence v. Texas, etc. that, I think, form the idea that people should have the right to plan their families and to have meaninful romantic relationships with whom they want).
Moreover, it's about the 14th Amendment. If you have a law that discriminates on the basis of sexual orientation, I think, post Lawrence v. Texas, intermediate scrutiny applies. I can't remember what the test entails exactly but the state must have, I think, at least a good reason for the rule. And that's where the argument falls apart. There's just no good reason for preventing homosexual men and women from marrying.
Appeals to maintaining the nuclear family ring hollow because there just is no conceivable link between letting Mr. Sulu marry his partner for over 30 years and the straight couple down the street getting a divorce. Even if the lowest level of analysis applies (whether the state has a legitimate interest and the rule is rationally related to that interest), Prop 8 would still fail.
Basically, gay marriage is inevitable and insecure straight people need to learn how to cope with it. I can't wait for someone to file for divorce citing gay marriage as the cause.

aeronaut, civil unions provide no financial protection and benefits for a same-sex couple, whereas a heterosexual would receive such privelege.

Some people voted Yes on Prop 8 because they were confused. They said on TV (at least in California) that Prop 8 was just about letting kids know the values of traditional marriage, probably to counter the amount of divorces. Then it says last minute that it is going to make Same Sex marriage illegal.
Luckily, I have a teacher who is very into politics to tell me the truth about Prop 8 early and I ripped out any Pro Prop 8 sign I saw on my way home.

I think prop 8 is a load of crap. It's like we're back to square one here. You think we would have learned from when interracial marriages were illegal. But no, good ol' U S of A is filled with homophobes using the Bible as an excuse to keep people from being happy.

I really don't see why people have a problem with any type of marriage. The fact that the government is run by fools who can't connect with the people they rule is ridiculous. Why does everyone care that some guy is kissing another guy? It isn't you being kissed is it? I once read an article about a 12 year old kid who was attracted to this other male in his school. The other male was disgusted at him and hated him. So one day, he marched into school, and shot him; just horrible. God damn. Just leave people alone, that's my view.
